The anti-subsidy investigation on Chinese Battery Electric Vehicles (BEVs) launched in October 2023 by the Commission has several key features that set it apart from all previous cases. It concerns an industry that is at the same time strategic for the EU and globalised, with major EU firms owning plants in China. This paper explores the economic and legal aspects of this case highlighting the peculiar pricing strategies of European and Chinese manufacturers, the policy conflict with the Green Transition and the EU’s own support for batteries.
